Our Chapter 13 Bankruptcy Practice
In a Chapter 13 proceeding, you agree to restructure all your debts and create a payment plan over a three- to five-year period. Some of your creditors may actually get paid nothing from your plan. Your creditors must stop all attempts to collect the debt from you.
When you hire us to assist you with a Chapter 13 filing, we will carefully examine your financial situation, looking at your potential income and your assets, as well as your obligations. We will file all the necessary documents to initiate the Chapter 13 proceeding, and will prepare and propose a plan of reorganization to the bankruptcy trustee and to your creditors.
We will act as your advocate in all meetings with the trustee or creditors and in all hearings and proceedings in the bankruptcy court. We will review any proposed repayment plans from your creditors or any modifications to our reorganization plan, confirming that the restructuring of the debt is in your best interests and within your means. If you commence a Chapter 13 case and are unable to complete it, you can lose all the protection of the bankruptcy laws. We can assist you with converting your case to Chapter 7 if needed.
